Business Talent Visa (Subclass 132)

The Business Talent Visa (Subclass 132) is a permanent resident visa for people who want to start or expand a new or existing business in Australia.It is necessary for applicants to have sufficient funds and a genuine desire to live in a specific Australian state or territory. Business owners will need to make a genuine and realistic commitment to maintain an ownership interest and participate in high-level business management in Australia. The subclass 132 visa is valid for five years, with the possibility of obtaining additional permanent residency visas or citizenship in the future.


Eligibility Criteria

  • A state or territory government must nominate you.
  • Submit an Expression of Interest via SkillSelect and you will be invited to apply.
  • Meet the physical and character requirements (including the dependent family members)
  • Comply with any additional stream requirements.

Streams

(i) Significant Business History Stream

Eligibility

Each stream has its own set of IRS and state nomination requirements.

To meet the South Australian nomination requirements, you must do the following:

  • Prior to submitting your State nomination application, you must have made an exploratory visit to South Australia (or be eligible for a virtual exploratory visit) and confirmed your genuine intent to do business and live in South Australia with a view to long-term settlement in this State.
  • You must commit to doing business or investing in South Australia and meet the benefit to state requirements.
  • Meet the visa eligibility criteria for the Business Talent Visa set out by the Australian Government's Department of Home Affairs.
  • Provide information to Skilled and Business Migration to allow for a two-year review after the visa is first activated. The information must include the nature of the business, its size, and which of the Benefit to State requirements you have met.
  • Expression of Interest (EOI) SkillSelect: You must have an EOI that meets the Department of Home Affairs 132 Significant Business History stream criteria as well as the state nomination requirement.


(ii) Venture Capital Entrepreneur Stream

Eligibility

To meet the South Australian nomination requirements, you must do the following

  • Prior to submitting your State nomination application, you must have made an exploratory visit to South Australia (or be eligible for a virtual exploratory visit) and confirm your genuine intent to do business and live in South Australia with a view to long-term settlement in this State (refer to section 1 of the 132 Significant Business History stream for detailed requirements).
  • In relation to your proposed business activity in South Australia, please provide a full business plan as well as a copy of your signed agreement.
  • Have a viable business idea approved for at least AUD$1,000,000 by an Australian Private Equity and Venture Capital Association Limited member or a South Australian business venture. The venture must benefit South Australia significantly economically, and intellectual property must be registered in Australia.
  • Meet the requirements of the Australian Government's Department of Home Affairs for the Venture Capital Entrepreneur visa.
